Judicial Conference Actions Re Privacy & Security of Electronic Case Files

Effective May 15, 2008, court transcripts will be made publicly available through the CM/ECF and PACER systems beginning 90 days after they are filed with the Clerk. Pursuant to federal policy, transcripts must be redacted to avoid disclosing certain personal information. Specifically,

  • Social Security numbers must be limited to the last 4 digits
  • Financial account numbers must be limited to the last 4 digits
  • Names of minor children must be limited to their initials
  • Dates of birth must be limited to the year of birth
  • Home addresses must be limited to the city and state (in criminal cases)

Accordingly, counsel are requested to avoid introducing this information into the record in the first place. Please take this into consideration when questioning witnesses or making other statements on the record. If a restricted item of personal information is mentioned in court, counsel may make a motion to have it stricken from the record or partially redacted to conform to the privacy policy. Federal Rule 5.2(c)(2(B)

All documents in Social Security cases have, until this point, been restricted from remote electronic public access. Members of the public have had remote electronic access through the Public Access to Court Electronic Records (PACER) system only to docket sheets in these cases.

In September 2006, however, the Judicial Conference adopted a proposed Federal Rule of Civil Procedure that specifically changes this access in Social Security cases, allowing public Internet access to “an opinion, order, judgment, or other disposition of the court, but not any other part of the case file or administrative record.” Pending Fed. R. Civ. P. 5.2(c)(2)(B). That rule, which has since also been approved by the Supreme Court, will go into effect on December 1, 2007, absent action by Congress to reject, modify, or defer it.

Local Rule Amendments
